The global water crisis is being exacerbated by climate change, even in the United States. Recycled water is a feasible alternative to alleviate the water shortage, but it is constrained by humans’ perceptions. The current study examines how residents’ water scarcity awareness and climate change belief influence their willingness to use recycled water directly and indirectly. Bayesian Mindsponge Framework (BMF) analytics was employed on a dataset of 1831 residents in Albuquerque, New Mexico, an arid inland region in the US. We (...) discovered that residents’ willingness to use direct recycled potable water is positively affected by their awareness of water scarcity, but only if they believe in the impacts of climate change on the water cycle. Meanwhile, the willingness to use indirect recycled potable water is influenced by water scarcity awareness, and the belief in climate change further enhances this effect. These findings implicate that fighting climate change denialism and informing the public of the water scarcity situation in the region can contribute to the effectiveness and sustainability of long-term water conservation and climate change alleviation efforts. Business ethicists should examine not only business practices but whether a particular type of business is even prima facie ethical. To illustrate how this might be done I here examine the contemporary U.S. defense industry. In the past the U.S. military has engaged in missions that arguably satisfied the just war self-defense rationale, thereby implying that its suppliers of equipment and services were ethical as well. Some recent U.S. military missions, however, arguably fail the self-defense rationale. At issue, then, is (...) whether a business supporting these latter missions may not be circumstantially unethical. No it is not, say defense industry advocates, for two principal reasons. For one, this business benefits society at large in numerous ways. And, for another, the organizer of these military missions is a superpower which by its very nature is not subject to the ethical constraints of the self-defense rationale. I dispute both reasons, argue against the second, and conclude that the U.S. military-industrial complex (MIC) is circumstantially unethical. (shrink)

Theorists of public reason such as John Rawls often idealize constitutional courts as exemplars of public reason. This paper raises questions about the seduction and limits of analogies between theorists’ account of public reason and actual constitutional jurisprudence. Examining the work product of the United States Supreme Court, the paper argues that while it does engage in reason-giving to support its decisions—as the public reason strategy suggests— those reasons are (largely) legalistic and specifically juristic reasons—not the theorists’ idealized moral-political reasons (...) on matters of fundamental principle. But if constitutional courts do not engage on matters of fundamental principle, then a public reason strategy for assuaging democratic worries about judicial review would no longer be open: prominent liberal and deliberative democratic theorists could no longer point to the alleged superiority of constitutional courts to speak in the name of, and for, the people’s shared political principles. The paper extends beyond the U.S. case study by pointing to three institutional factors explaining the disanalogy between what some constitutional courts do and what public reason theories require them to do. It concludes with considerations about whether the public reason strategy might be more successfully applied to international courts. (shrink)

Corporate social responsibility has become a focal point for research aimed at extending business ethics to extra-corporate issues; and as a result many companies now seek to at least appear dedicated to one or another version of CSR. This has not affected the arms industry, however. For, this industry has not been discussed in CSR literature, perhaps because few CSR scholars have questioned this industry's privileged status as an instrument of national sovereignty. But major changes in the organization of political (...) communities call traditional views of sovereignty into question. With these considerations in mind I assess the U.S. arms industry on the basis of CSR requirements regarding the environment, social equity, profitability, and use of political power. I find that this industry fails to meet any of these four CSR requirements. Countering a claim that these failings should not be held against arms manufacturers because their products are crucial to national defense, I contend that many of these companies function not as dutiful agents of a nation-state but as politically powerful entities in their own right. So, I conclude, they should be held responsible for the foreseeable consequences that flow from use of their products. This responsibility should include civil liability and, in cases involving war crimes and violations of human rights, responsibility under international human rights standards. (shrink)

After the 9/11 attacks the U.S. administration went beyond emergency response towards imperialism, but cloaked its agenda in the rhetoric of fighting ‘terrorists’ and ‘terrorism.’ After distinguishing between emergency thinking and emergency planning, I question the administration’s “war on terrorism” rhetoric in three stages. First, upon examining the post-9/11 antiterrorism discourse I find that it splits into two agendas: domestic, protect our infrastructure; and foreign, select military targets. Second, I review approaches to emergency planning already in place. Third, after reviewing (...) what philosophers have said about emergencies, I recommend they turn their attention to the biases inherent in and misleading uses of antiterrorist terminology. (shrink)

Just war theory needs to become a real-time critique of government war propaganda in order to facilitate peace advocacy ante bellum. This involves countering asserted justificatory reasons with demonstrable facts that reveal other motives, thereby yielding reflective understanding which can be collectivized via electronic media. As a case in point, I compare here the publicly declared reasons for the U.S./U.K. invasion of Iraq in 2003 with reasons discussed internally months and even years before in government and think-tank documents. These sources (...) show that control of oil rather than regime change or a WMD threat was theunderlying motive. Neo-conservatives in the Bush Administration justified such deception by citing an exoteric/esoteric distinction traceable to Plato via Leo Strauss. As with the Iraq invasion, so in general such propaganda and its rationalizations can be undermined by investigative journalism understood as ranging from fact gathering to rhetorical analysis and critique. The U.S. doctrine of employment-at-will, modified legislatively for protected groups, is being less harshly applied to managerial personnel. Comparable compensation is not otherwise available in the U.S. to workers displaced by technology. Nine pairs of arguments are presented to show how fundamentally management and labor disagree about a company's responsibility for its former employees. These arguments, born of years of labor-management debate, are kaleidoscopic claims about which side has what power. Ultimately, however, not even both together can solve without creative (...) public intervention the emerging problem of massive technological unemployment — the other side of the corporate dream of profit without payrolls. A description of consciousness leads to a contradiction with the postulation from special relativity that there can be no connections between simultaneous event. This contradiction points to consciousness involving quantum level mechanisms. The Quantum level description of the universe is re- evaluated in the light of what is observed in consciousness namely 4 Dimensional objects. A new improved interpretation of Quantum level observations is introduced. From this vantage point the following axioms of consciousness is presented. Consciousness consists of two distinct (...) components, the observed U and the observer I. The observed U consist of all the events I is aware of. A vast majority of these occur simultaneously. Now if I were to be an entity within the space-time continuum, all of these events of U together with I would have to occur at one point in space-time. However, U is distributed over a definite region of space-time (region in brain). Thus, I is aware of a multitude of space-like separated events. It is seen that this awareness necessitates I to be an entity outside the space-time continuum. With I taken as such, a new concept called concept A is introduced. With the help of concept A a very important axiom of consciousness, namely Free Will is explained. (shrink)

There has been a growing concern over establishing norms that ensure the ethically acceptable and scientifically sound conduct of clinical trials. Among the leading norms internationally are the World Medical Association's Declaration of Helsinki, guidelines by the Council for International Organizations of Medical Sciences, the International Conference on Harmonization's standards for industry, and the CONSORT group's reporting norms, in addition to the influential U.S. Federal Common Rule, Food and Drug Administration's body of regulations, and information sheets by the Department of (...) Health and Human Services. There are also many norms published at more local levels by official agencies and professional groups.Any account of international standards should cover both scientific and ethical norms at once – the two are conceptually intertwined. Recent sources recognize that “[s]cientifically unsound research on human subjects is unethical in that it exposes research subjects to risks without possible benefit.”. (shrink)

U članku se promatraju osnovne karakteristike razvojne dinamike hrvatskoga logičkoga nazivlja od izlazka Pacelove Logike za gimnazije, prve sustavne logike na hrvatskome jeziku, 1868. godine, pa sve do Petrovićeve Logike, također za srednja učilišta, iz 1964., koja je još uviek u uporabi. Nazivlje je u tu svrhu razvrstano u nekoliko tipičih skupina. Općenito, uočava se porast zastupljenosti latinizama (i grecizama) na štetu hrvatskih naziva. U analizi nazivlja autor se ograničuje na knjige namienjene nastavi logike bilo na srednjim učilištima, bilo na (...) sveučilištu, i to na nazivlje tradicionalne logike. This paper analyzes several significant polemics in Serbian philosophy, published in philosophical journals and daily papers during past two decades. These are polemics between Milorad Belančić and Slobodan Žunjić, Nenad Daković and Slobodan Žunjić, and Mihailo Marković and Aleksandar Prnjat, respectively. In the first polemic, the two authors discuss the ontological status of several philosophical terms; in the second one, authors negotiate the importance of translating and publishing F. Copleston's A History of Philosophy, whilst in the third polemic, the two (...) philosophers discuss the problem of paternalism, suggesting redefinition of some aspects of this problem. (shrink)

The first beginnings of modern logic in Croatia are recognizable as early as in the middle of the 19th century in Vatroslav Bertić. At the turn of the 20th century, Albin Nagy, who was teaching in Italy, made contributions to algebraic logic and to the philosophy of logic. At that time, a distinctive author Mate Meršić stood out, also working on algebraic logic. In the Croatian academic philosophy, until the publication of Gajo Petrović's textbook (1964) and the contributions by Heda (...) Festini, a critical or indifferent attitude toward modern logic prevailed. The first comprehensive modern logic textbook in Croatian was written by mathematician Vladimir Devidé (1964), known, for example, for his axiomatizations of natural numbers and classical propositional logic. In the Croatian philosophy of the 1980s and 1990s, influential logicians are Goran Švob and mathematician Zvonimir Šikić. At the turn of the 21st century, logical investigations are being intensified and extended to various branches of the contemporary logic. (shrink)

Among the many problems facing u.s. immigration law is a crisis of discretion and judicial deference. Through two recently passed laws, the United States Congress and the President have seriously limited judicial review o f discretionary immigration decisions o f the Board ofImmigration Appeals. This Article focuses on this preclusion of judicial review of discretionary agency decisions. The Article begins with an examination ofdiscretion from a theoretical perspective, and goes on to examine areas o f immigration law in which discretion (...) was traditionally most imponant. That examination is followed by a discussion of immigration-law scholarship and critique. The Article concludes that what is needed in U.S. immigration law is greater restraint, and calls on the Judiciary to provide more oversight regarding discretionary agency decisions. (shrink)

Instead of the half-century old foundational feud between set theory and category theory, this paper argues that they are theories about two different complementary types of universals. The set-theoretic antinomies forced naïve set theory to be reformulated using some iterative notion of a set so that a set would always have higher type or rank than its members. Then the universal u_{F}={x|F(x)} for a property F() could never be self-predicative in the sense of u_{F}∈u_{F}. But the mathematical theory of categories, (...) dating from the mid-twentieth century, includes a theory of always-self-predicative universals--which can be seen as forming the "other bookend" to the never-self-predicative universals of set theory. The self-predicative universals of category theory show that the problem in the antinomies was not self-predication per se, but negated self-predication. They also provide a model (in the Platonic Heaven of mathematics) for the self-predicative strand of Plato's Theory of Forms as well as for the idea of a "concrete universal" in Hegel and similar ideas of paradigmatic exemplars in ordinary thought. Élie HALÉVY (1870-1937), philosophe et historien des idées, fut professeur à l'École libre des sciences politiques, l'ancêtre de l'actuel Sciences Po. Comme son autre grand ouvrage, l'Histoire du peuple anglais au XIXe siècle, paru en six tomes de 1913 à 1932, les trois tomes de La formation du radicalisme philosophique, parus en 1901 pour les deux premiers et en 1904 pour le troisième, reflètent pour partie ses enseignements de l'Ecole libre consacrés à l'histoire britannique. Le premier tome, La jeunesse de (...) Bentham 1776-1789, étudie la doctrine utilitariste non seulement chez celui qu'on regarde comme son fondateur principal, Jeremy Bentham, mais aussi chez les nombreux auteurs qui, en Grande-Bretagne et sur le continent, en dessinèrent avant lui les contours. Le deuxième tome, L’évolution de la doctrine utilitaire de 1789 à 1815, montre comment l'utilitarisme revêtit la forme non seulement d'une école de pensée, mais aussi d'un mouvement pour la réforme économique, sociale et politique. Le rôle coordonnateur nouveau de James Mill, ainsi qu'une convergence de vues avec les économistes, qui poussaient dans le sens des réformes, marquèrent notamment cette évolution. Le troisième tome, Le radicalisme philosophique, continue d'étudier la transformation de l'école en mouvement après la fin des guerres napoléoniennes, lorsque celle-ci commence à engranger ses premiers grands succès réformistes. Bentham, James Mill et les autres penseurs utilitaires sont alors réunis sous l'appellation de philosophic radicals. Le terme temporel de l'ouvrage est le Reform Act de 1832, première étape vers la modernisation du système électoral, que la propagande de ce groupe ne contribua pas peu à faire aboutir. Quoique l'ouvrage d'Halévy vaille en premier lieu par l'immense savoir qu'il déploie, et le nombre et l'excellence des citations qu'il propose, il comporte aussi des thèses historiques et philosophiques originales. On peut citer parmi les premières la thèse, qui relie les trois tomes, voulant que l'utilitarisme britannique trouve sa forme achevée dans l'intervention sur la société, lorsqu'il se mue en radicalisme philosophique, et parmi les secondes, la thèse, énoncée au début du premier tome, voulant qu'il existe trois modèles dominants de jonction des intérêts individuels (la fusion sympathique, l'identification naturelle et l'identification artificielle). Une autre grande thèse, à la fois historique et philosophique, affirme en substance que l'économie politique classique serait un département spécialisé de la pensée utilitaire. La question de savoir jusqu'à quel point Smith, Ricardo et Malthus ont pu adhérer au "principe d'utilité" de Bentham est toujours débattue. En même temps que les élucidations apportées à ce principe, elle contribue à expliquer l'intérêt que les historiens de la pensée économique continuent de porter à l'ouvrage. L'auteur a participé à la réédition de La formation du radicalisme philosophique en 1995 par les Presses Universitaires de France (P.U.F.), suivant un projet collectif lancé par Monique Canto-Sperber. Dans le présent article, antérieur à cette réédition, l'auteur tentait de résumer brièvement un livre qui demeure irremplaçable en dépit d'une conception et d'un style quelque peu datés. (shrink)

The United Kingdom's Parliamentary Bill 'Fraud Trials (Without a Jury) 2007', failed. Nevertheless, fraud trials without a jury do take place and there is much evidence to support this. Today the UK still does not support fraud trials without a jury, even though fraud in the UK today is the highest amount of fraud globally. The longer version of this paper is submitted here since it has become urgent that UK fraud trials be examined as a matter of urgency. On (...) page 87 of this complete paper (cut down for The Criminal Lawyer in 2008) a U.S study of 46 corporate fraud trials revealed that the defendants were CEOs, President, Chairman, Senior Vice Presidents, Chief Financial Officers, but only one entity reach trial stage. After the ce Arthur Anderson LLP v. United States, 544 U.S. 696 (2005), and the Lehman Brothers SEC case and the SEC v. Bank of America Corp., 653 F. Supp. 2d 507 (S.D.N.Y. 2009, and the Report by the U.S. Financial Crisis Inquiry on the 2008 financial crash, a global financial disaster was predicted and George Osborne, UK Chancellor pleaded for leniency for HSBC Bank frauds, threatening a global meltdown. The U.S. judiciary increased its volume of Deferred Prosecution Agreements and the UK followed suit. So, in year 2022, there is global financial meltdown and the UK has the highest rate of fraud in the world with few successful convictions. This paper is very relevant today as we must stop using deferred prosecution agreements and seek more convictions and harsh jail sentences for those financial fraudsters who have created this meltdown. -/- *When this paper was written, UK fraud was estimated at £40 million and some experts suspected twice that amount. Two rival accounts of irony claim, respectively, that pretence and echo are independently sufficient to explain central cases. After highlighting the strengths and weaknesses of these accounts, I argue that an account in which both pretence and echo play an essential role better explains these cases and serves to explain peripheral cases as well. I distinguish between “weak” and “strong” hybrid theories, and advocate an “integrated strong hybrid” account in which elements of both pretence and echo are seen as complementary (...) in a unified mechanism. I argue that the allegedly mutually exclusive elements of pretence and echo are in fact complementary aspects enriching a core structure as follows: by pretending to have a perspective/thought F, an ironic speaker U echoes a perspective/thought G. F is merely pretended, perhaps caricaturised or exaggerated, while G is real/possible. (shrink)

Le XI.ème Congrès International de Philosophie Médiévale de la Société Internationale pour l’Étude de la Philosophie Médiévale (S.I.E.P.M..) s’est déroulé à Porto (Portugal), du 26 au 30 août 2002, sous le thème général: Intellect et Imagination dans la Philosophie Médiévale. A partir des héritages platonicien, aristotélicien, stoïcien, ou néo-platonicien (dans leurs variantes grecques, latines, arabes, juives), la conceptualisation et la problématisation de l’imagination et de l’intellect, ou même des facultés de l’âme en général, apparaissaient comme une ouverture possible pour aborder (...) les principaux points de la pensée médiévale. Les Actes du congrès montrent que « imagination » et « intellect » sont porteurs d’une richesse philosophique extraordinaire dans l’économie de la philosophie médiévale et de la constitution de ses spécificités historiques. Dans sa signification la plus large, la théorisation de ces deux facultés de l’âme permet de dédoubler le débat en au moins six grands domaines: — la relation avec le sensible, où la fantaisie/l’imagination joue le rôle de médiation dans la perception du monde et dans la constitution de la connaissance ; — la réflexion sur l’acte de connaître et la découverte de soi en tant que sujet de pensée ; — la position dans la nature, dans le cosmos, et dans le temps de celui qui pense et qui connaît par les sens externes, internes et par l’intellect ; — la recherche d’un fondement pour la connaissance et l’action, par la possibilité du dépassement de la distante proximité du transcendant, de l’absolu, de la vérité et du bien ; — la réalisation de la félicité en tant qu’objectif ultime, de même que la découverte d’une tendance au dépassement actif ou mystique de toutes les limites naturelles et des facultés de l’âme ; — la constitution de théories de l’image, sensible ou intellectuelle, et de ses fonctions. Les 3 volumes d’Actes incluent les 16 leçons plénières et 112 communications, ainsi que les index correspondants (manuscrits ; noms anciens et médiévaux ; noms modernes ; auteurs). Le volume IV des Actes, contenant 39 communications et des index, est publié par la revue " Mediaevalia. Cílem článku je ukázat, že německá raná romantika, která položila filosofické základy romantického hnutí, nebere příklon k subjektivitě prožívání jako odklon od poznání, nýbrž jako jiný způsob poznání. Romantická niternost nachází svůj protějšek ve zkušenosti světa, jemuž umění dokáže propůjčit hlubší význam než racionální filosofie a věda. Tento nový pohled na poznání je romantiky použit jak na výklad přírody, tak duchovní lidské skutečnosti. Článek upozorňuje na to, že vedle dědictví spinozismu měla romantická epistemologie důležitý zdroj v některých úvahách Kantovy Kritiky (...) soudnosti. Tato vazba je sledována zvláště na příkladu filosofie umění F. W. J. Schellinga. Argumentace článku je rozvinuta v kritické konfrontaci se subjektivistickou interpretací romantiky H.-G. Gadamera, čímž se ozřejmuje její širší epistemologický dosah i aktuálnost. Návaznost německých romantiků na Kantovu Kritiku soudnosti se spíše než tendencí k subjektivizaci estetiky projevovala ve snaze o estetizaci poznání. (shrink)

Článek se věnuje srovnání podoby a vývoje sporu o vivisekce v Anglii a českých zemích, s důrazem na propojení protivivisekčního a ženského hnutí. První část textu na pozadí rozvoje medicíny popisuje okolnosti vzniku sporu a cestu, která vedla k přijetí první legislativy regulující experimenty se zvířaty. Druhá část představuje postoj F. P. Cobbeové, která je nejvýraznější ženskou postavu v tomto sporu. Třetí část mapuje situaci v českých zemích a nabízí důvody, které vysvětlují, proč se u nás v dané době organizované (...) protivivisekční hnutí nezformovalo. Autorka tvrdí, že klíčovou roli sehrálo pozitivní vnímání vědců, které pramenilo z jejich zapojení do procesu národního obrození. V poslední části textu jsou pak představeny názory na vivisekci dvou postav českého ženského hnutí na počátku 20. století, P. Moudré a E. Vozábové. Autorka ukazuje, že v dané době argumenty, které líčily experiment v medicíně jako nepotřebnou a neužitečnou metodu bádání, již nemohly být přesvědčivé. (shrink)

In order to graduate, Florida's high school students by law must learn that Communism is evil, dangerous, and fallacious. All students must learn that the U.S. produces the highest standard of living and more freedom than any other economic system on earth. State universities in Florida are creating a curriculum to implement the Americanism versus Communism Act of 1961 and the Free Enterprise and Consumer Education Act of 1975. ;The Florida Department of Education says that ideology, noncritical thinking, is superior (...) to critical thinking and that the superiority of the U.S. political economy and the dignity of the individual rest in part on peoples' being able to express themselves freely. ;Florida's A.V.C. and F.E.C.E.A. proponents have a special way of convincing audiences that they will develop loyalty while at the same time imposing a set of ideas not open to question. ;This work argues that, intentionally or not, Florida's legislature and Department of Education have set up an official ideology and the mechanism to purvey it. This ideological approach defeats the aim of comparing systems objectively. While the stated aim is to promote critical thinking, the D.O.E.'s special philosophy underscoring words like "democracy" results in indoctrinating students with a questionable description of the U.S. system. Historical reconstructions of the effects of the intellectual migration are typically informed by one of two conflicting narratives. Some scholars argue that refugee philosophers, in particular the logical positivists, contributed to the demise of distinctly American schools of thought. Others reject this ‘eclipse view’ and argue that postwar analytic philosophy can best be characterized as a synthesis of American and positivist views. This paper studies the fate of one of the most influential schools of U.S. philosophy—Columbia naturalism—and argues that both (...) narratives are part of a larger story. First, I reconstruct the rise of the Columbia school, focusing on its naturalist analyses of science, morality, and religion as well as its contributions to the history of ideas. Next, I trace some of the naturalists’ contacts with German philosophers and show that they encountered a strong bifurcation between historical and scientific philosophy in their discussions. I argue that a similar distinction gradually infected debates between naturalists, eventually resulting in a split within the Columbia school itself. The historically-oriented naturalists, I argue, were overshadowed by the analytic movement, whereas the science-minded naturalists were able to incorporate the views of the émigrés, thereby developing the tradition in new directions. The Simulation Hypothesis proposes that all of reality, including the earth and the universe, is in fact an artificial simulation, analogous to a computer simulation, and as such our reality is an illusion. In this essay I describe a method for programming mass, length, time and charge (MLTA) as geometrical objects derived from the formula for a virtual electron; $f_e = 4\pi^2r^3$ ($r = 2^6 3 \pi^2 \alpha \Omega^5$) where the fine structure constant $\alpha$ = 137.03599... and $\Omega$ = 2.00713494... (...) are mathematical constants and the MLTA geometries are; M = (1), T = ($2\pi$), L = ($2\pi^2\Omega^2$), A = ($4\pi \Omega)^3/\alpha$. As objects they are independent of any set of units and also of any numbering system, terrestrial or alien. As the geometries are interrelated according to $f_e$, we can replace designations such as ($kg, m, s, A$) with a rule set; mass = $u^{15}$, length = $u^{-13}$, time = $u^{-30}$, ampere = $u^{3}$. The formula $f_e$ is unit-less ($u^0$) and combines these geometries in the following ratio M$^9$T$^{11}$/L$^{15}$ and (AL)$^3$/T, as such these ratio are unit-less. To translate MLTA to their respective SI Planck units requires an additional 2 unit-dependent scalars. We may thereby derive the CODATA 2014 physical constants via the 2 (fixed) mathematical constants ($\alpha, \Omega$), 2 dimensioned scalars and the rule set $u$. As all constants can be defined geometrically, the least precise constants ($G, h, e, m_e, k_B$...) can also be solved via the most precise ($c, \mu_0, R_\infty, \alpha$), numerical precision then limited by the precision of the fine structure constant $\alpha$. Objective: The aim of this study was to compare oral Artemether-Lumefantrine to intravenous Quinine by exploring its effectiveness in cerebral malaria in hospitalized patients. Materials and Methods: A randomized prospective study was conducted among 64 hospitalized cases of cerebral malaria. One group of patients was treated with intravenous Quinine and another group was treated with oral Artemether-Lumefantrine. Response in clinical, laboratory parameters and outcome of treatment were noted every eight hours. Results: Oral Artemether-Lumefantrine showed almost similar response in clinical and (...) laboratory parameters with median temperature (101º F), pulse rate (102 b/m), systolic BP (110mmHg), GCS (12), hemoglobin (9.8 g/dl), WBC (9000/μl), platelet (130000/μl), B. glucose (101 mg/dl), S. creatinine (1.8 mg/dl), ALT (32 U/L), mean disappearance time of parasite from blood (40 hours), and mean time for regaining full consciousness (30 hours). Final outcome was also similar in both drugs with only 1 death (3.1%) reported in each group. Conclusion: In cerebral malaria intravenous Quinine or oral Artemether-Lumefantrine therapy does not have any statistically significant difference in terms of clinical parameter, laboratory parameter and final outcome. Notre étude sur le temps grec précédant la pensée d Aristote commencera d'abord par un commentaire de son premier texte, le Protreptique. Nous verrons se dégager deux temps distincts : l'un initiatique, circulaire et d'inspiration platonicienne, et l'autre diamétralement opposé dont Aristote serait le défenseur. Afin d'interroger cette dichotomie, nous retournerons aux conceptions poétiques. Les Tragiques nous permettront d'offrir une première esquisse de cette notion dans l'univers grec (Du destin...). Ensuite, l'oeuvre épique d'Homère sera l'occasion de mieux saisir le nouage (...) existant entre le temps et la sphère religieuse (Des héros...). Le travail du grand théologue Hésiode viendra confirmer cette vision initiatique, comme l'avait déjà remarquablement exposée F. Nietzsche (Des mythes...). C'est alors que nous plongerons au sein du pythagorisme afin de parachever cette vision (Des mystères...). Notre compréhension de ce courant, traversé par la théogonie iranienne, nous permettra, ensuite, de bien le distinguer de celui dit «ionien» et ainsi de s'éloigner de la parole platonicienne (De l'idéologie...). In The Rationality of Induction, David Stove presents an argument against scepticism about inductive inference—where, for Stove, inductive inference is inference from the observed to the unobserved. Let U be a finite collection of n particulars such that each member of U either has property F-ness or does not. If s is a natural number less than n, define an s-fold sample of U as s observations of distinct members of U each either having F-ness or not having F-ness. Let (...) pU denote the proportion of members of U that are Fs and, if S is an s-fold sample of U, let pS denote the proportion of members of S that are Fs. Call S representative if and only if |pS – pU|<0.01. Stove‘s argument against inductive scepticism is built on the following statistical fact: -/- As s gets larger the proportion of all possible s-fold samples of U that are representative gets closer to 1 (regardless of the size of U or of the value of pU). -/- In this essay I subject Stove‘s argument to thorough scrutiny. I show that the argument – as it stands – is incomplete, and I illuminate the issues involved in trying to fill the gaps. Animal ethics has often been criticized for an overreliance on “ideal” or even “utopian” theorizing. In this article, I recognize this problem, but argue that the “nonideal theory” which critics have offered in response is still insufficient to make animal ethics action-guiding. I argue that in order for animal ethics to be action-guiding, it must consider agent-centered theories of change detailing how an ideally just human-animal coexistence can and should be brought about. I lay out desiderata that such a theory (...) of change should suffice so as to be helpful in guiding action. Specifically, a theory of change should determine (1) who needs to do what in order for ideal justice to be achieved in the long run, (2) who should be expected to refuse compliance and how they should be moved to comply, and (3) why specific intermediate steps are necessary. I show how previous “nonideal” contributions, though helpful in other ways, are insufficiently determinate on these points and I sketch a (still somewhat utopian) theory of change for one specific context. This brings animal ethics a crucial step closer to being action-guiding in the real world. (shrink)

This open access book revises Kant’s ethical thought in one of its most notorious respects: its exclusion of animals from moral consideration. The book gives readers in animal ethics an accessible introduction to Kant’s views on our duties to others, and his view that we have only ‘indirect’ duties regarding animals. It then investigates how one would have to depart from Kant in order to recognise that animals matter morally for their own sake. Particular attention is paid to Kant’s ‘Formula (...) of Humanity,' the role of autonomy and the moral law, as well as Kant’s notions of practical reason and animal instinct. The result is a deliberately amended version of Kantianism which nevertheless remains faithful to central aspects of Kant’s thought. The book’s final part illustrates the framework’s use in applied contexts, addressing the issues of using animals as mere means, the ethics of veganism and vegetarianism, and environmental protection. Nico Dario Müller shows how, when furnished with duties to animals, Kant's moral philosophy can be a powerful resource for animal ethicists. (shrink)

Building on her previous work (2004, 2012, 2013), Christine Korsgaard’s recent book Fellow Creatures (2018) has provided the most highly developed Kantian account of duties towards animals. I raise two issues with the results of this account. First, the duties that Korsgaard accounts for are duties “towards” animals in name only. Since Korsgaard does not reject the Kantian conception in which direct duties towards others require mutual moral constraint, what she calls duties “towards” animals are merely Kantian duties regarding animals, (...) verbally repackaged. Hence, Korsgaard’s account is best understood as an expansion (albeit a substantial one) of Kant’s own view of an indirect duty regarding animals. Second, the expansion does not take us quite as far as Korsgaard hopes. She aims for a conception in which our duties towards animals and humans are equally important, but her argument does not support this conclusion. I point out the potential for a more radical revision of Kant’s anthropocentrism that rejects his underlying assumption that duties towards others are based on mutual constraint. (shrink)

Causal finitism claims nothing can have an infinite causal history. An influential defense of this position uses infinity paradoxes to argue that, if causal finitism is false, several impossible scenarios would be possible. In this paper, I defend that theists should not be persuaded by this argument. If true, this is an important development, since causal finitism is often argued for by theists as a core premise in Kalam-style cosmological arguments for theism. I extend the same analysis to an argument (...) in favor of temporal finitism and conclude that my point may generalize to any reasoning of a similar structure. (shrink)

In 1985, German sociologist Niklas Luhmann published a monograph on ecology, which appeared in English translation in 1989 as Ecological Communication. It contained many original insights for ecological thinking and, despite being well-reviewed upon publication, has had a relatively minor impact on Anglophone environmental discourse. This inattention is also present in environmental law, which has recently seen an increase in legal theories that challenge its mainstream. This contribution first investigates why Ecological Communication has received scant attention, pointing to changes in (...) the climatic context in which it first appeared and the reactionary nature of its arguments. Recognising that the work nevertheless contains critical theoretical insights for environmental law scholarship, the second aim of the article is to spotlight what from Ecological Communication remains relevant at the hand of three common claims progressive researchers level against mainstream environmental law: The critique of law's marriage to Cartesian dualism, that law should be better informed by climate science,of and law's anthropocentrism. Finally, environmental lawyers are called upon not to ignore Ecological Communication but to engage with it fruitfully. (shrink)

The following article was written to honour Johan Buitendag’s contribution to the discipline of eco-theology. Assuming an interdisciplinary stance, eco-theology in general and his work, in particular, is observed from the position of legal theory and sociology. As such, eco-theology is not assessed on theological grounds but is treated interdisciplinary through comparison with environmental law. More specifically, the project of eco-theology is shown to share certain characteristics with the nascent subdiscipline of Earth systems law within environmental law. It is argued (...) that one of the most important of these is the use of norms as an ecological strategy. This is understandable as both the religious and legal systems rely on the norm form to a lesser or greater extent. However, in the legal sociology of systems theory, the shortcomings of norms have been eloquently argued. This article thus posits the limits of norms to eco-theology and Earth systems law as a challenge deserving attention. However, social systems theory has its shortcomings, and a preliminary line of flight away from this challenge is suggested in the shape of Agamben’s description of the monastic form-of-life, where life and norm overlap so intensely that suggestions of a new worldview gain plausibility. The article aims at contrasting the autopoietic understanding of an individual and her or his actions as described by Niklas Luhmann with Paul Ricoeur’s notion of narrative identity, focusing on people as legal subjects. The article assumes that when legal subjects necessitate ethical engagement and evaluation, the law could cease to deal with problems in a mere legalistic fashion but is allowed the freedom to appeal to norms of justice external to itself as in other natural law theories. Through narrative (...) identity the deeds of role players are to be understood in greater complexity than what a self-referential legal system is comfortable in dealing with. (shrink)

The theoretical underpinnings of public international law have taken the sovereign status of the nation-state for granted since the beginning of the modern era. After centuries of evolution in legal and political thought, the state's definition as a bounded territorial unit has been strictly codified. The legal development of the nation-state was an ideological project informed by extra-legal considerations. Additionally, the ever-narrowing scope of the juridical idea of sovereignty functioned as a boundary mechanism instrumental in colonising Africa and other regions. (...) While international law claims universal liberalism today, the current system based on sovereign nation-states represents not social inclusion but fierce and dangerous exclusion. -/- The central thesis of this book is that the development of legal sovereignty was, rather than part of the modernist progress narrative, a historically contingent evolutionary regression. While other social systems such as economics and science became globalised, politics and law counterintuitively became more territorialised. It is argued that the nation-state today is not only anachronistic but is dangerously ill-equipped for facing international problems such as the climate crisis or global pandemics. Finally, it also leaves African states and many other formerly-colonised territories at a particular disadvantage by regulating their political practices into a predefined mould. (shrink)

Criticism of big data has focused on showing that more is not necessarily better, in the sense that data may lose their value when taken out of context and aggregated together. The next step is to incorporate an awareness of pitfalls for aggregation into the design of data infrastructure and institutions. A common strategy minimizes aggregation errors by increasing the precision of our conventions for identifying and classifying data. As a counterpoint, we argue that there are pragmatic trade-offs between precision (...) and ambiguity that are key to designing effective solutions for generating big data about biodiversity. We focus on the importance of theory-dependence as a source of ambiguity in taxonomic nomenclature and hence a persistent challenge for implementing a single, long-term solution to storing and accessing meaningful sets of biological specimens. We argue that ambiguity does have a positive role to play in scientific progress as a tool for efficiently symbolizing multiple aspects of taxa and mediating between conflicting hypotheses about their nature. Pursuing a deeper understanding of the trade-offs and synthesis of precision and ambiguity as virtues of scientific language and communication systems then offers a productive next step for realizing sound, big biodiversity data services. Under the title 'Truth', Strawson and Evans discuss the question as to whether the distinction between genuinely fact-stating uses of language and other uses can be grounded on a theory of truth, especially a 'thin' notion of truth in the tradition of F P Ramsey.

Many philosophers endorse “exclusionism”, the view that no instance of relearning qualifies as a case of genuine remembering, and vice versa. Appealing to simulationist, distributed causalist, and trace minimalist theories of remembering, I develop three conditional arguments against exclusionism. First, if simulationism is right to hold that some cases of remembering involve reliance on post-event testimonial information, then remembering does not exclude relearning. Second, if distributed causalism is right to hold that memory traces are promiscuous, then remembering does not exclude (...) relearning. Finally, if trace minimalism is right to hold that vicarious experiences sometimes produce the minimal traces that ground remembering, then remembering does not exclude relearning. While advocates of these theories might incorporate additional conditions designed to accommodate exclusionism, the only reason they can appeal to in favor of doing so is intuition: neither the fundamental components of the theories nor the empirical results on which they are based provide a reason to endorse exclusionism. An investigation of exclusionism thus raises metaphilosophical questions, so far overlooked in philosophy of memory, about the appropriate role of intuition in theorizing about remembering. (shrink)

Environmental philosophy – broadly conceived as using philosophical tools to develop ideas related to environmental issues – is conducted and practised in highly diverse ways in different contexts and traditions in Asia. ‘Asian environmental philosophy’ can be understood to include Asian traditions of thought as well as grassroots perspectives on environmental issues in Asia. Environmental issues have sensitive political facets tied to who has the legitimacy to decide about how natural resources are used. Because of this, the works, practices, and (...) researchers in Asian environmental philosophy are exposed to being (mis)used by diverse stakeholders and actors to support political ends not related to environmental sustainability. Two processes are at play at the nexus of the construction of identities in relation to conceptualisations of nature: eco-orientalism and ecological nationalisms. This paper analyzes and exemplifies these dynamics through a conceptual framework that distinguishes ideological and socio-technical explanations of environmental degradation. Finally, to minimise the risks of political misuse, five pathways are presented to carefully help curate environmental, philosophical statements: contextualise, quantify uncertainty and ‘uniqueness’, downscale, confront claims with local realities and literature, and collaborate with researchers from other disciplines. Conjointly, these pathways aim at favouring intercultural collaboration while valuing diversity, thus supporting the development and exchanges in environmental philosophy in Asia and beyond. According to buck-passers about art, such as Dominic Lopes, every work of art belongs to some art. I distinguish two versions of the buck-passing theory of art—what I call the double-buck-passers’ (DBP) view and the single-buck-passers’ (SBP) view—and point out that Lopes’s view is an instance of the latter. Then I argue the SBP view faces a dilemma, each horn of which leads to trouble. In doing so, I explore uncharted territory: the implications of vagueness for theories of art. Neuroscience has studied deductive reasoning over the last 20 years under the assumption that deductive inferences are not only de jure but also de facto distinct from other forms of inference. The objective of this research is to verify if logically valid deductions leave any cerebral electrical trait that is distinct from the trait left by non-valid deductions. 23 subjects with an average age of 20.35 years were registered with MEG and placed into a two conditions paradigm (100 trials for (...) each condition) which each presented the exact same relational complexity (same variables and content) but had distinct logical complexity. Both conditions show the same electromagnetic components (P3, N4) in the early temporal window (250–525 ms) and P6 in the late temporal window (500–775 ms). The significant activity in both valid and invalid conditions is found in sensors from medial prefrontal regions, probably corresponding to the ACC or to the medial prefrontal cortex. The amplitude and intensity of valid deductions is significantly lower in both temporal windows (p = 0.0003). The reaction time was 54.37% slower in the valid condition. Validity leaves a minimal but measurable hypoactive electrical trait in brain processing. The minor electrical demand is attributable to the recursive and automatable character of valid deductions, suggesting a physical indicator of computational deductive properties. It is hypothesized that all valid deductions are recursive and hypoactive. (shrink)

Quasi-Nelson logic (QNL) was recently introduced as a common generalisation of intuitionistic logic and Nelson's constructive logic with strong negation. Viewed as a substructural logic, QNL is the axiomatic extension of the Full Lambek Calculus with Exchange and Weakening by the Nelson axiom, and its algebraic counterpart is a variety of residuated lattices called quasi-Nelson algebras. Nelson's logic, in turn, may be obtained as the axiomatic extension of QNL by the double negation (or involutivity) axiom, and intuitionistic logic as the (...) extension of QNL by the contraction axiom. A recent series of papers by the author and collaborators initiated the study of fragments of QNL, which correspond to subreducts of quasi-Nelson algebras. In the present paper we focus on fragments that contain the connectives forming a residuated pair (the monoid conjunction and the so-called strong Nelson implication), these being the most interesting ones from a substructural logic perspective. We provide quasi-equational (whenever possible, equational) axiomatisations for the corresponding classes of algebras, obtain twist representations for them, study their congruence properties and take a look at a few notable subvarieties. Our results specialise to the involutive case, yielding characterisations of the corresponding fragments of Nelson's logic and their algebraic counterparts. (shrink)

I present a possible worlds semantics for a hyperintensional belief revision operator, which reduces the logical idealization of cognitive agents affecting similar operators in doxastic and epistemic logics, as well as in standard AGM belief revision theory. (Revised) belief states are not closed under classical logical consequence; revising by inconsistent information does not perforce lead to trivialization; and revision can be subject to ‘framing effects’: logically or necessarily equivalent contents can lead to different revisions. Such results are obtained without resorting (...) to non-classical logics, or to non-normal or impossible worlds semantics. The framework combines, instead, a standard semantics for propositional S5 with a simple mereology of contents. (shrink)

What does social justice require in contemporary societies? What are the requirements of social democracy? Who and where are the individuals and groups that can carry forward agendas for progressive social transformation? What are we to make of the so-called new social movements of the last thirty years? Is identity politics compatible with egalitarianism? Can cultural misrecognition and economic maldistribution be fought simultaneously? What of the heritage of Western Marxism is alive and dead? And how is current critical social theory (...) to approach these and other questions? Much of the most productive work done in recent social theory has revolved around such issues, in particular, around those concerning the relationship between the politics of recognition and the politics of distribution. After the intense theoretical focus over the last fifteen years or so on the issues of recognition politics—multiculturalism, multi-nationalism, identity politics, group-differentiated rights, the accommodation of difference, and so on—some social theorists have worried that attention has been diverted from important issues of distributive equality—systematic impoverishment, increasing material inequality, ‘structural’ unemployment, the growth of oligarchic power, global economic segmentation, and so on. While some critics seem to have adopted a blunt ‘it’s the economy, stupid’ line of criticism,1 others have attempted to develop an overarching, integrative theoretical framework adequate to the diverse issues concerning both economic and cultural justice. For example, Axel Honneth proposes that a suitably developed and normatively robust theory of intersubjective recognition can adequately integrate an analysis of apparently diverse contemporary struggles: those for a just division of labor and hence, a fair distribution of resources and opportunities, as well as those for a culture free of identity-deforming disrespect and denigration. In this paper, I aim to do three things. First, I introduce the distinction between the Uniqueness Thesis (U) and what I call the Conditional Uniqueness Thesis (U*). Second, I argue that despite their official advertisements, some prominent uniquers effectively defend U* rather than U. Third, some influential considerations that have been raised by the opponents of U misfire if they are interpreted as against U*. The moral is that an appreciation of the distinction between U and U* helps to (...) clarify the contours of the uniqueness debate and to avoid a good deal of talking past each other. (shrink)
